| Hey all,
What exactly are the rules behind sampling? By rules, I mean copyright related issues. For example, hypothetically, if I were to sample a song, and sell it... would there be any consequences? Would I have to get prior permission, or give recognition to the artist I would be sampling from? That kinda stuff... Thanks.

| i've sold a sampled beat and i'm still alive...BUT (and this is a big one (Y) < like that big) there's nothing stopping the people that own the copywright sueing you for using their song...You could give recognition, but if you chopped it so much they don't recognise it then your killin yourself lmao. But yea, the real way to go about it is to contact them and get clearence to use the sample....but unless your gonna make a lot off it, they prolly gonna say no.. But like i said, i've sold sampled beats and have lived to tell the tale lolz. generally if your small time and not that well known chances are you'll be okay But the official rule is...Don't smaple without clearence | | | de Soundclick :)

| Unless the song you sell ends up making major money i doubt you'll have to worry about any legal disputes. | | | |

Sample clearence is the responsibility of the artist.
actually, I don't think it is. I cba to find the background on this, but it's not true. I think people think it is whoever, because it is the artists name, it is the artist who is putting it out. But simply, sampling without clearance is infringement of copyright, plain and simple. Its possible to clear a sample if you want (think it'll set you back a good $1000 for the legal work and paper work etc.) But generally, if your sampling and putting the song on soundclick, no-one is gonna come after you | | AIM - The2ndMan2

| not a thousand for the clearance....for the PAPERWORK...
its the responsibility of the person selling the music to get it cleared... so with selling a sampled track..best thing to do is sell the rights as well and just make sure you get royalties off the track....if the person is paying enough to buy the rights...
